Lan Peru fined for ilegal fees

I just heard on the news that Lan Peru is being fined for ilegally charging a $75 change fee. According to the standard contract of carriage approved by Peru, every consumer has a right to one change on domestic flights, so the fee was illegal.

They have a heafty fine with the government and they have to refund to fees to anyone who paid them.

Further, the story mentioned that Indecopi is also investigating the extra fee charged for non residents.

That's excellent news. Hopefull, the $180 fee for non residents will be abolished soon. :D

Actually, it doesn't say anything about the $180 gringo fee. Just about the $75 for changes.

I wasn`t reacting to your post but about the newsarticle that teamoperu mentioned.

Sorry for complimenting you on the good catch, I take it back. I should have known not to be nice here. I was fully aware you said you heard it so I thought I might be helpful and post a print version as confirmation. Even the almighty AmeriCorps might not catch all the details, or transmit them, so a print version might be useful - such as correcting that multiple changes are included in the ruling. But for sure, I'll remember never to compliment you again.

Wow. What a valuable contribution to the topic at hand. Thanks, and come again.

As my BFF Josh and I discovered on the Translation Forum, LAN in Peru has some special situations for changing/endorsing tickets. It appears that INDECOPI ruling refers to infringing the articles 47 and 66.7 of the Código de Protección y Defensa del Consumidor, hence referring to this special situation.

So the ruling is disallowing charges for changes in these tickets – not all tickets. Translated, this means for Base family tickets – resident only tickets - LAN cannot charge a multa for changes. And that limiting this to only once is also disallowed.
